Needing a great real estate lawyer?

Jed Mutone: You need a trial lawyer with real estate trial experience. Not a real estate lawyer.To find one, go to the local Court Clerk's Office and CASUALLY ask one of the desk clerks, what trial attorney files a bunch of cases. Or, at the Clerk's office ask to see some cases with homeowner's associations as Defendants. Look at the case files, see who won and the name of the attorney that won.Go to a big real estate office and ask what trial attorney they use....Show more

Lorelei Lilburn: Here is a brief summary on whats going on.... I got behind on my fees and I have paid half of it so far but still owe some more. I've been trying to negotiate with the association lawyer to go on a payment plan but no luck. Also, I have a dog, which is not allowed unless you are the original owner of the unit, but like I told the lawyer that my dog is more for emotional support than anything else and can get! a letter from a therapist stating that but he said it doesn't matter. Finally, to cap it off my water heater broke and soaked all the carpet and I ended up removing all carpets and there is a good change of molding in my unit. I'm planning on fixing my place up but if they are going to foreclose then there is not point in me fixing it up then......Show more

You can try to sell your house by yourself, but most potential buyers aren't driving around looking for "for sale by owner" signs in front of a house -- they are talking with their real estate agent about what houses to look at and scanning the Multiple Listi! ng Service (available to real estate agents) to sort through t! he possibilities. Agents marketing property send out the listings to other agents and hold agent-only showings to interest the buyers' agents in the house. I suppose you could do all that, but it would be rough. Also, of course, selling agents split their commissions with the buyers' agents, thereby giving the buyers' agents an incentive to show the house to potential buyers. If you don't at least offer a buyer's agent a half-commission, you will be standing next to that "for sale by owner" sign for a long time....Show more

Brenton Cornwall: Go to your yellow pages and find attorney referral services. When you call do not explain problem just that you need a real estate attorney. Then call the state board and ask if they have any complaints on that particular attorney. They will be able to help you.Your HOA has an attorney on staff so please be aware of what is said to you,any letters,phone calls,communications,etc. Write down all times,dates,people you spoke with e! tc. Then if the time comes to go to court you have that paperwork to show your side of the story. Depending on the issues that the HOA has, they can put a lien on your home. You as a homeowner are allowed to attend any meeting except the ones that are private and only the HOA committee has to attend.It will be a bumpy ride but you can have the outcome you want as long as you have written proof to back you up.
