Can I change a car registration in NY if the car loan is under someone else s name ?

Derick Kinnard: No

Dick Ovdenk: No, there is no legal way for you to rework the paperwork and have the vehicle become legally yours. No way in hell. The lender won't allow it, the insurer won't allow it, the state won't allow it, and neither will any court of law. All the documents say the vehicle is owned by your parents, and documentation is god in any courtroom. It doesn't matter who paid the down payment, doesn't matter who paid the monthly instalments, doesn't matter who pays for the registration and / or insurance, nor does it matter who pays for the fuel and oil changes. The only thing that matters is whose name is printed on the official documents, and that name isn't yours. It's not your vehicle unless your name appears on the official paperwork....Show more

Vida Miss: While the law varies from state to state, in most states if a person's name is on the title then they have to sign off on the title before their name can be removed. Your father wo! uld have to authorize the title change. You can not do it.But, by the same token, since your name is on the title, he can not remove you (or sell the car, etc) without your authorization. Or without you signing off on the title. Now, because there is a loan on the car, it may not be legal for him to sign off of the title. If he signs off the title, he no longer owns the car. If he then stopping making the payments on it, the bank can not repossess the car, etc to try to regroup their money. So in most states you can not sign off the title of a car on which you still have a loan. In fact, states will not even give you a copy of the title as long as there is a loan on it. Whoever has the loan holds on to the title until the loan is paid.So odds are that you can not get your father off the title as long as there is a loan on it, or he refuses to sign off on the title....Show more
